Der Kaufvertrag kommt dadurch zustande,
* wenn ein Artikel in den Warenkorb gelegt wird und die Zahlung per PayPal erfolgt,
* das Bestellformular für Überwei-sungen übermittelt und die Konto-daten mitgeteilt wurden,
* eine formlose Bestellung über unsere E-Mail-Adresse oder per Post eingeht und die Zahlungsmodalitäten übermittelt wurden,
* eine systemgenerierte Bestellung per E-Mail an unsere E-Mail-Adresse eingeht, welcher ein vorab geschlos-sener Konditionenvertrag zugrunde liegt.
Der Verkäufer wird die Bestellung des Käufers grundsätzlich annehmen. Der Verkäufer behält sich die Annahme jedoch insbesondere dann vor,
* wenn sich für den Verkäufer aus den Angaben des Käufers der be-gründete Verdacht ergibt, dass der Käufer seine vertraglichen Verpflich-tungen nicht ordnungsgemäß erfüllen wird.
* wenn sich aus nicht vertrags-getreuem Verhalten des Käufers bei der Abwicklung eines anderen Kauf-vertrages mit dem Verkäufer ergibt, dass der Käufer seine vertraglichen Verpflichtungen nicht ordnungsgemäß erfüllen wird.
Der Vertragsschluss wird im System des Verkäufers mit den vom Käufer übermittelten Daten gespeichert.

mittels einer eindeutigen Erklärung (z. B. vorzugsweise per E-Mail oder ein mit der Post versandter Brief) über euren Entschluss, diesen Vertrag zu widerrufen, informieren. Ihr könnt das formlos erledigen. Zur Wahrung der Widerrufsfrist reicht es aus, dass ihr die Mitteilung über die Ausübung des Widerrufsrechts vor Ablauf der Widerrufsfrist absendet.
Folgen des Widerrufs
Wenn ihr diesen Vertrag widerruft, haben wir euch alle Zahlungen, die wir von euch erhalten haben, mit Ausnahme der zusätzlichen Kosten, die sich daraus ergeben, dass Sie eine andere Art der Lieferung als die von uns angebotene, günstigste Standardlieferung gewählt haben, unverzüglich und spätestens binnen vierzehn Tagen ab dem Tag zurückzuzahlen, an dem die Mitteilung über euren Widerruf dieses Vertrags bei uns eingegangen ist. Für diese Rückzahlung verwenden wir dasselbe Zahlungsmittel, das ihr bei der ursprünglichen Transaktion ein-gesetzt habt, es sei denn, mit euch wurde ausdrücklich etwas anderes vereinbart; in keinem Fall werden euch wegen dieser Rückzahlung Entgelte berechnet. Wir können die Rückzahlung verweigern, bis wir die Waren wieder zurückerhalten haben oder bis ihr den Nachweis erbracht haben, dass ihr die Waren zurück-gesandt habt, je nachdem, welches der frühere Zeitpunkt ist. Ihr habt die Waren unverzüglich und in einwand-freiem Zustand und in jedem Fall spätestens binnen vierzehn Tagen ab dem Tag, an dem ihr uns über den Widerruf dieses Vertrags unterrichtet, an uns zurückzusenden oder zu übergeben. Die Frist ist gewahrt, wenn ihr die Waren vor Ablauf der Frist von vierzehn Tagen absendet. Ihr tragt die unmittelbaren Kosten der Rücksendung der Waren. Ihr müsst für einen etwaigen Wertverlust der Waren nur aufkommen, wenn dieser Wertverlust auf einen zur Prüfung der Beschaffenheit, Eigen-schaften und Funktionsweise der Waren nicht notwendigen Umgang mit ihnen zurückzuführen ist.
Ausschluss bzw. vorzeitiges Erlöschen des Widerrufsrechts:
Ein Widerrufsrecht besteht nicht bei Lieferungen von digitalen Versionen der Publikationen. Ebenso gewähren wir bei Privatverkäufen kein Rück-gaberecht, da die Publikationen nicht verschweißt versandt werden. Das Widerrufsrecht besteht lediglich bis zum Versand der Ware.
§ 2 Lieferung
Die Lieferung erfolgt an die vom Käufer angegebene Lieferadresse. Innerhalb der Bundesrepublik Deutschland erfolgt die Post- oder Paketlieferung versandkostenfrei, außer der Käufer bevorzugt einen schnelleren Versand. Die Lieferung innerhalb Deutschlands erfolgt bei einzelnen Exemplaren bis zu einem Gewicht von 1 kg per BÜWA (Bücher- Warensendung), ab 1 kg erfolgt die Lieferung per DPD. Für die Lieferung ins Ausland wird eine Versandkosten-pauschale über € 4,--/5,-- pro Auftrag erhoben, je nach Zielland. Die Kosten für Paketlieferungen über 1 kg werden zu 50% vom Käufer getragen. Zusätzliche Steuern sowie Zölle für Auslandslieferungen trägt der Käufer. Der Verkäufer ist zu Teillieferungen berechtigt. Wir ver-senden eure Ware spätestens am zweiten Arbeitstag nach Bestell-eingang. Der Versand erfolgt innerhalb von 3-5 Werktagen (ins Ausland bis zu 10 Werktagen).
§ 3 Fälligkeit und Zahlung, Verzug
Der Kaufpreis bei Privatbestellungen ist vor der Auslieferung ohne Abzug fällig. Der Käufer kann den Kaufpreis bei Postlieferung durch Überweisung im Lastschriftverfahren über PayPal zahlen. Gleiches gilt bei Bestellungen von Kunden außerhalb Deutschlands. Eine Barzahlung (z.B. per Bargeld im Briefumschlag oder durch Übergabe) ist aus technischen Gründen nicht möglich.
§ 4 Zurückbehaltung, Aufrechnung
Ein Zurückbehaltungsrecht kann der Käufer nur ausüben, wenn sein Gegenanspruch auf dem gleichen Vertragsverhältnis beruht. Ein Recht zur Aufrechnung steht dem Kunden nur zu, wenn seine Gegenansprüche rechtskräftig festgestellt, unbestritten oder vom Verkäufer anerkannt sind. Dies gilt nicht für Gewährleistungs-ansprüche.
§ 5 Verzug
Der Verzug tritt nach den gesetzlichen Regelungen ein. Ist der Käufer Kaufmann, so vereinbart er mit dem Verkäufer den Verzicht auf eine Mahnung. Befindet sich der Käufer im Verzug, so kann der Verkäufer Verzugszinsen in Höhe von 5 % über dem jeweils gültigen Basiszinssatz der Europäischen Zentralbank verlangen. Das Recht des Verkäufers, einen nachweisbaren höheren Schaden geltend zu machen, bleibt hiervon ebenso unberührt wie das Recht des Kunden, einen niedrigeren Schaden nachzuweisen.
§ 6 Gewährleistung
Liegt ein vom Verkäufer zu vertreten-der Mangel an der Kaufsache vor, so ist der Verkäufer nach seiner Wahl zur Mängelbeseitigung oder zur Ersatzlieferung berechtigt. Schlägt die Mängelbeseitigung oder Ersatzlieferung fehl, so ist der Käufer berechtigt, vom Kaufvertrag zurück-zutreten oder Minderung zu verlan-gen. Nicht bestellte oder mangelhafte Ware ist vom Käufer unter genauer Bezeichnung der Ware und Art des Fehlers an den Verkäufer zurück-schicken. Die Kosten für die Rücksendung von nicht bestellter oder mangelhafter Ware werden dem Käufer in jedem Fall erstattet.
§ 7 Eigentumsvorbehalt
Die gelieferte Ware bleibt bis zu ihrer vollständigen Bezahlung im Eigentum des Verkäufers.
§ 8 Anwendbares Recht und Gerichts-stand
Ist der Käufer Kaufmann, gelten folgende Bestimmungen: Für die gesamten Rechtsbeziehungen zwischen Käufer und Verkäufer gilt deutsches Recht unter Ausschluss des UN-Kaufrechts. Im Falle eines etwaigen Weiterverkaufs hat der Käufer die deutschen Preisbindungs-vorschriften zu beachten. Der Verkäufer ist berechtigt, nach seiner Wahl am Gerichtsstand seines Geschäftssitzes oder am allgemeinen Gerichtsstand des Käufers zu klagen.
§ 9 Salvatorische Klausel
Sollten einzelne Bestimmungen des Vertrages einschließlich dieser Regelungen ganz oder teilweise unwirksam sein, oder sollte der Vertrag eine Lücke enthalten, bleibt die Wirksamkeit der übrigen Bestimmungen oder Teile solcher Bestimmungen unberührt. Anstelle der unwirksamen oder fehlenden Bestimmungen treten die jeweiligen gesetzlichen Regelungen.

by means of a clear statement (e.g. preferably by email or a letter sent by post) of your decision to withdraw from this contract. You can do this informally. To meet the cancellation deadline, it is sufficient that you send the notification of the exercise of the right of cancellation before the cancellation period has expired.
consequences of revocation
If you cancel this contract, we will refund all payments that we have received from you, with the exception of the additional costs resulting from the fact that you have chosen a different type of delivery than the cheapest standard delivery offered by us, promptly and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged any fees for this refund. We may refuse to refund until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is earlier. You must return or hand over the goods to us promptly and in perfect condition and in any event no later than fourteen days from the date on which you notify us of the cancellation of this contract. This deadline is met if you send the goods before the expiry of the fourteen-day period. You will bear the direct cost of returning the goods. You only have to pay for any loss of value of the goods if this loss of value is due to handling of the goods which is not necessary to check their quality, properties and functioning.
Exclusion or premature expiry of the right of withdrawal:
There is no right of cancellation for deliveries of digital versions of publications. We also do not grant a right of return for private sales, as the publications are not sent sealed. The right of cancellation only applies until the goods are dispatched.
§ 2 Delivery
Delivery is made to the delivery address specified by the buyer. Within the Federal Republic of Germany, postal or parcel delivery is free of charge, unless the buyer prefers faster delivery. Delivery within Germany for individual copies up to a weight of 1 kg is by book shipment, and from 1 kg onwards, delivery is made by DPD. For deliveries abroad, a flat shipping fee of € 4.00/5.00 per order is charged, depending on the destination country. The buyer bears 50% of the costs for parcel deliveries over 1 kg. Additional taxes and customs duties for deliveries abroad are borne by the buyer. The seller is entitled to make partial deliveries. We will ship your goods no later than the second working day after receipt of the order. Shipping takes place within 3-5 working days (abroad up to 10 working days).
§ 3 Due date and payment, default
The purchase price for private orders is due in full before delivery. The buyer can pay the purchase price for postal delivery by direct debit via PayPal. The same applies to orders from customers outside Germany. Cash payment (e.g. by cash in an envelope or by handing over the goods) is not possible for technical reasons.
§ 4 Retention, offsetting
The buyer can only exercise a right of retention if his counterclaim is based on the same contractual relationship. The customer only has the right to offset if his counterclaims have been legally established, are undisputed or have been recognized by the seller. This does not apply to warranty claims.
§ 5 Default
Default occurs according to the statutory regulations. If the buyer is a merchant, he agrees with the seller to waive a reminder. If the buyer is in default, the seller can demand default interest of 5% above the current base interest rate of the European Central Bank. The seller's right to claim demonstrably higher damages remains unaffected, as does the customer's right to prove lower damages.
§ 6 Warranty
If there is a defect in the purchased item for which the seller is responsible, the seller is entitled to choose between remedying the defect or providing a replacement. If remedying the defect or providing a replacement fails, the buyer is entitled to withdraw from the purchase contract or demand a reduction in price. Any goods that were not ordered or are defective must be returned to the seller by the buyer, specifying the exact nature of the goods and the type of defect. The costs for returning goods that were not ordered or are defective will be reimbursed to the buyer in any case.
§ 7 Retention of Title
The delivered goods remain the property of the seller until they have been paid for in full.
§ 8 Applicable Law and Place of Jurisdiction
If the buyer is a merchant, the following provisions apply: German law applies to all legal relationships between buyer and seller, excluding the UN Convention on Contracts for the International Sale of Goods. In the event of any resale, the buyer must observe German price fixing regulations. The seller is entitled to sue at the place of jurisdiction of his place of business or at the general place of jurisdiction of the buyer, at his discretion.
Should individual provisions of the contract, including these regulations, be invalid in whole or in part, or should the contract contain a gap, the validity of the remaining provisions or parts of such provisions shall remain unaffected. The respective statutory regulations shall take the place of the invalid or missing provisions.

scope of services
The descriptions in our advertising publications and, in particular, the information in our booking confirmations are generally binding for the scope of our services. Additional agreements must be made in writing. Deviations from the contents are permitted, provided they are specific to off-road adventure and outdoor events. Unexpected road conditions, adverse weather conditions or arbitrary decisions by the authorities can lead to changes in the tour program.
The tour itinerary can be changed depending on current circumstances, interests, progress and weather conditions. Prices are subject to changes in dates, prices and services, errors and availability at the time of booking and reconfirmation by the service providers (guides, ferries and hotels). Accommodation can be exchanged if not available. Changes to the tour itinerary or accommodation do not result in any reduction in the travel price. The agreed services are based on the valid tour description, taking into account the local customs and the aspect of the trip as an experience, adventure or expedition trip.
duty to cooperate
Every tour participant is obliged to cooperate in the event of disruptions within the framework of proportionality in order to avoid or minimize any damage. The tour guide's instructions must be followed. If these are not followed, the organizer can cancel the tour immediately without notice.

The offers in the brochures and other publications as well as on the Internet correspond to the status at the time of publication. The offers in the booking confirmations are binding. We reserve the right to change the travel price accordingly or according to the price list if the costs incurred by us increase significantly or the number of participants falls. In individual cases, this requires written confirmation from the travel participants. Package deals or individually calculated prices are not automatically transferable. The terms of payment are also regulated in the specific offers. In principle, payment must be made no later than 10 days before the start of the tour / event. We have no influence on the pricing of resellers and agencies.
service and price changes
All trips offered are experience, adventure or expedition trips that may involve special risks. The tour guide may make changes to the time, route or service for compelling reasons. There is no right to compensation. If additional costs exceed 10% of the trip price arise for unforeseen reasons, these are to be borne by the customer.
withdrawal by the customer
The participant can withdraw from the contract at any time. The decisive factor is the receipt of the written declaration by the organizer/agent. If the participant withdraws from the contract or does not take the tour, the organizer can demand compensation for the preparation and expenses. The following flat-rate cancellation rates apply:

Liability
The organizer (guide) is liable within the scope of the duty of care for the conscientious preparation of the event, the careful monitoring and selection of the service providers and the accuracy of the service description. In the case of third-party services, the person providing the third-party service is fully liable. The content of our services involves a particular risk of danger. Participation is voluntary. No liability is accepted for damaged, dirty or lost vehicles / clothing / equipment etc. The organizer accepts no liability for accidents or injuries caused by participants themselves or caused (negligently or intentionally).
Before starting the trip, the customer undertakes to take out an emergency insurance policy (e.g. ADAC), which at least covers the return transport of the traveler and the vehicle in the event of illness, accident or death.
Health/Hygiene
Physical/health restrictions of participants that must be taken into account in the organization or that may affect the course of the tour must be communicated to the organizer in advance. This applies in particular to heart/circulatory/respiratory problems or impairments of the musculoskeletal system. Participants who are under the influence of drugs or alcohol can be excluded from the event. Taking into account the special nature of adventure trips and events, the food and eating culture may be at a simple level. Nevertheless, the concerns of hygiene, health protection and expiration dates/perishability are taken into account.
It is also pointed out that during such activities the requirement for standardised sanitary facilities cannot always be met.
General Provisions
The general passport, visa, customs, foreign exchange and health regulations must be observed. The customer is responsible for this. Advice from the tour guide is to be seen as assistance and not binding. Any disadvantages incurred by the customer due to non-compliance will be at the customer's expense.
Disclaimer + Declaration of Participants
There is an exclusion of liability for any claims against the organizer, his helpers, the site owner and the site tenant. The driver is liable for all damage caused by him, his vehicle and passengers. The passenger is equally liable for any damage caused by him. All participants take part in the event/trip at their own risk. They bear sole civil and criminal responsibility for all damage caused by themselves or their vehicle. This also applies to damage caused to you and your vehicle. Seat belts are compulsory for all persons in the vehicle. During the tours, participants must adhere to the instructions and route recommendations of the organizer and his helpers; if the instructions are not followed, the participants concerned may be excluded.
If a participant damages another participant's vehicle through carelessness, recklessness or inattention, this participant may be excluded. The organizer will decide on this, taking into account the injured party's opinion and a written declaration for insurance purposes between those involved. Drivers are prohibited from drinking alcohol during driving times. All vehicles must be insured against personal injury and property damage. Participants have private liability insurance. Anyone with a valid driver's license is eligible to take part as a starter/participant. A driver briefing will be held before the first vehicle starts. The respective country's road traffic regulations and the resulting insurance-related issues (also between participants) apply!!!

Otherwise, the statutory provisions apply (e.g. the three-year limitation period for claims for repayment of a deposit).
Cancellation by the organizer (guide)
The organizer, in this case the respective guide, can withdraw from the tour/event, especially if the priced number of participants is not reached (must be set out in writing), payment is not made, or in the event of force majeure and if official requirements fundamentally endanger the character of the tour. We also reserve the right to withdraw from the offer if the economic sacrifice limit is exceeded after all lesser options have been exhausted. The contractual partner must be informed of this in writing up to 10 days before the event/trip. The organizer can also withdraw from the contract after the tour/event has started, especially if bad weather or unforeseen events could pose a risk to the participants. In the cases mentioned, the participants will be reimbursed for their respective share of the costs (pro rata travel price). The priority is to offer the participant an alternative date. In the event of violence, war or natural disasters at the tour/event location, both contractual parties can withdraw from the contract without notice. Furthermore, we will refrain from carrying out the trip in the event of illness or family reasons.

The organizer reserves the right to terminate the travel contract after the start of the trip if the customer persistently disrupts the process despite a warning, endangers fellow travelers or otherwise behaves in a way that is contrary to the contract, such that immediate termination of the contract is justified. In this case, there is no entitlement to a refund of the travel price.
Termination due to exceptional circumstances after the start of the trip
Each contracting party can terminate the contract if an unforeseen event such as war, epidemics, political unrest or similar occurs in the countries. The organizer (guide) is obliged to enable the customer to return home. Any additional costs resulting from this are borne by the customer. The same applies to irreparable damage to one of the travel vehicles. In the event of delays resulting from necessary repairs or if the trip is cancelled, there is no entitlement to replacement or reimbursement for services not provided; this applies in particular if the customer cancels voluntarily.
Liability
The organizer (guide) is liable within the scope of the duty of care for the conscientious preparation of the event, the careful monitoring and selection of the service providers and the accuracy of the service description. In the case of third-party services, the person providing the third-party service is fully liable. The content of our services entails a particular risk of danger. Participation is voluntary. No liability is accepted for damaged, dirty or lost vehicles / clothing / equipment etc. The organizer accepts no liability for accidents or injuries caused by participants themselves or caused (negligently or intentionally).
Before starting the trip, the customer undertakes to take out an insurance policy (e.g. ADAC), which at least covers the return transport of the traveler and the vehicle in the event of illness, accident or death.
Health/Hygiene
Physical/health restrictions of participants that must be taken into account in the organization or that may affect the course of the tour must be communicated to the organizer in advance. This applies in particular to heart/circulatory/respiratory problems or impairments of the musculoskeletal system. Participants who are under the influence of drugs or alcohol can be excluded from the event. Taking into account the special features of adventure trips and events, the food and eating culture may be at a simple level. Nevertheless, the concerns of hygiene, health protection and expiration dates/perishability are taken into account.
It is also pointed out that during such activities the requirement for standardized sanitary facilities cannot always be met.
General Provisions
The general passport, visa, customs, foreign exchange and health regulations must be observed. The customer is responsible for this. Advice from the tour guide is to be seen as assistance and not binding. Any disadvantages incurred by the customer due to non-compliance are at the customer's expense.
Disclaimer + Declaration of Participants
There is an exclusion of liability for any claims against the organizer, his helpers, the site owner and the site tenant. The driver is liable for all damage caused by him, his vehicle and passengers. The passenger is equally liable for any damage caused by him. All participants take part in the event/trip at their own risk. They bear sole civil and criminal liability for all damage caused by themselves or their vehicle. This also applies to damage caused to you and your vehicle. Seat belts are compulsory for all persons in the vehicle. During the tours, participants must adhere to the instructions and route recommendations of the organizer and his helpers; if the instructions are not followed, the participants concerned may be excluded.
If a participant damages another participant's vehicle through carelessness, recklessness or inattention, that participant may be excluded. The organizer will decide on this, taking into account the injured party's opinion and a written declaration for insurance purposes between those involved. Drivers are prohibited from drinking alcohol during driving times. All vehicles must be insured against personal injury and property damage. Participants have private liability insurance. Anyone with a valid driver's license is eligible to take part as a starter/participant. A driver briefing will be held before the first vehicle starts. The respective country's road traffic regulations and the resulting insurance-related issues (also between participants) apply!!!
